  • Eminent domain is the state’s power to take private property for public use, if the owner is paid just compensation. The exercise of this power is commonly called condemnation. There are dozens of different governmental and private parties that have eminent domain authority, and numerous specific purposes for which property can be condemned. In our opinion, there is no such thing as a “typical” or “routine” condemnation case. 

    Condemnation cases involve a unique mix of constitutional law, property law, and special procedures required by statute.     Getting the right legal help early makes a big difference. Condemning authorities are best served by hiring a qualified eminent domain attorney as soon as they know an acquisition might be necessary. Property owners should retain counsel as soon as they receive a "notice of intent" informing them that a condemning authority may seek to acquire their property.
